Divorce is the dissolution of the marriage
relationship by the judgment of the Court.
Arizona
is a total no-fault State. What that
means is that you don't need a reason for a divorce. The Judge doesn't care why you want the
divorce or who was the "bad" person.
There are two types of divorce: Non-Contested Divorce and Contested Divorce.
In
a non-contested divorce, you and your spouse agree on EVERYTHING. You agree that you are getting the divorce,
division of property, alimony (spousal maintenance) and division of debts; if
you have children you agree on child custody, visitation and child
support. In a non-contested divorce,
there is nothing that you don't agree on.
Even if you're fighting over a spoon, it becomes a contested divorce. In
a contested divorce, you don't agree on everything.
To file for divorce, one of the parties
(either the husband or wife) must have resided in Arizona for at least 90 days
before filing for divorce. In addition, people in the military who are
stationed in Arizona and have resided here for at least 90 days may also file
for divorce.
Arizona is a Community Property State. That means that all property that a person
had before marriage is their separate property . Separate property also includes property
acquired by a spouse by gift or inheritance during the marriage. Any
increase in value of separate property is also considered separate property of
the spouse. Most property acquired or
accumulated after marriage is Community Property. This is a very generalized definition of
property. There are many twists and
